Emergency Medical Treatment and Labor Act

The Emergency Medical Treatment and Labor Act (EMTALA) is a complex law established in the United States in 1986, which ensures that any person who requires emergency healthcare will be able to receive a medical screening examination in hospital emergency departments (and some other health care centers), regardless of citizenship, legal status or ability to pay. Further, the law ensures that if a medical emergency does exists, the hospital will have the obligation to provide appropriate care to the patient. The requirements and details of the law are beyond the scope of this document, and you should seek private legal counsel for a complete interpretation of the law. What should be clearly stated here and understood by the user is that Symptify.com is not a part of the EMTALA screening process. In no way does this site participate in the screening of and/or triage of patients in a hospital. The information gathered and transmitted is not part of the medical assessment of the user nor is it the property of the hospital or any other health care facility. The screening process that falls under EMTALA begins when a patient presents in person to the hospital.

Because hospitals and other healthcare facilities on Symptify.com may not all fall under the requirements of EMTALA, responsibility to determine the EMTALA obligations of the facility fall on the user. By using Symptify, you acknowledge that Symptify is not subject to the application of EMTALA, AND you agree that you will not seek a private right of action against Symptify with relation to any breach of EMTALA or other malpractice on the part of any hospital or other healthcare facility.

Jurisdiction for any and all disputes with Symptify.com or your use of the site resides in the courts of the State of Florida. If you use the site, you agree that these Terms shall be construed in accordance with the laws of the State of Florida without regard to its conflict of laws provisions.

Users who access Symptify.com have an option to create a personal account or use their Facebook or Twitter accounts. In order to register, users will be asked to provide some personal and health information. Registered users will have access to certain features that are not available to non-registered users.

Examples of personal information that registered users will be asked to provide include but are not limited to name, email address, gender, medical history and age. This information will be utilized to personalize the user's experience and to periodically seek feedback to improve the overall experience on the site or application. No user information will be shared with third parties without the expressed consent of the user.

Furthermore, in order for the site to operate effectively, Symptify.com will collect health information. Examples of data collected include but are not limited to symptoms, past medical and surgical history, medications and allergies. The information collected will be utilized in two general ways. The first will be to personalize user experience. Health information will help the application to ask relevant and appropriate questions and avoid redundant and unnecessary ones. For example, health questions only applicable to males will not be asked of females. The application will also be able to generate a more accurate list of probable causes of the user's symptoms by incorporating this health information. For example, if a user has already had an appendectomy, the application will not include appendicitis as a cause of the user's symptoms. Thus, health information allows Symptify.com to create the most accurate and personalized experience possible for its users.

A second way that health information will be utilized is by looking at information collectively, in a manner that is not identifiable to any particular user - in other words, information that is anonymous. This collective data will allow Symptify.com to better understand patterns of illness, accuracy of the algorithmic engine, and general health and demographic information about its users. Should Symptify.com share any information with partner organizations or other Third Parties, the data will be anonymous and shared in a manner that cannot be traced back to any individual user.

Symptify.com sends cookies to the computer or mobile device of its users in order to improve user experience, including storing user preferences, gathering and analyzing trends, and improving the accuracy of results. Symptify.com also gathers other relevant user data that enables the Company to understand user trends and improve the quality of the site and the mobile device application. For example, the site and mobile device application gather information about the user interaction with the site, including search terms, time and date, and browser used.

Furthermore, user communication with Symptify.com may be kept to respond to questions and requests and improve the service offered. Symptify.com may communicate with users through their email addresses.

Sharing User Information

In order to share user information with any Third Party organization or individual, including partner organizations or media groups, Symptify.com has determined that the following strict criteria must first be met:

Explicit user consent must be secured
User chooses, out of his/her own volition, to transmit personal information and medical profile to a participating healthcare facility in order to facilitate medical care
To comply with legal requirements, such as a law, regulation, search warrant, subpoena, or court order;
In the event of a corporate change in control resulting from, for example, a merger, a sale of assets, or bankruptcy; or
In special cases, such as in response to a physical threat to you or others.
Symptify.com does not make your Personal Information available to third parties for their marketing purposes.

Security and Protection of User Privacy

Symptify.com considers user privacy to be of the highest priority. Although there is no way to ensure complete security with respect to transmission of information over the internet or with respect to the storage of information and data, Symptify.com undertakes measures to the degree possible within reason to protect Personal Information and Health Information under its control. The Company cannot guarantee security of its servers or that user information will be 100% secure.

Furthermore, information transmitted to hospitals, urgent care centers, offices of physicians, or other health care institutions uses technology that may pass beyond the control or jurisdiction of Symptify. As such, the Company cannot guarantee 100% the privacy of the information transmitted. Symptify.com does not assume any liability for the failure, interception, delay, or other adverse events, relating to the transmission of user information.

If for any reason user information has been breached or possibly been compromised in any way, that user should contact Symptify.com immediately. See "Contact Us"T below for instructions.

Terminating an Account or Changing User Information

Generally speaking, instructions for changing or updating user information are provided directly on the site. For any questions that are not addressed within the site, users should contact Symptify.com via the "Contact Us" instructions below. In order to terminate an account, users should contact Symptify.com via the "Contact Us" instructions below. Symptify.com has a general policy to respond to emails within a 48-hour period, although this may not always be possible due to volume or extenuating circumstances.

In the event that Symptify.com becomes involved in a merger, transfer, joint venture, acquisition, or any other form of sale of some or all of its assets, the Company will ensure confidentiality of user information and will notify users prior to the transfer of personal information which might subsequently fall under a new Privacy Policy.
